GRAHAM AMENDMENT PASSES: HABEAS CORPUS
SUSPENDED for "enemy
combatants" which could include anyone the President chooses. According to the New York Times: "The five Democrats voting for the
bill were Senators Joseph I. Lieberman of Connecticut, Mary L. Landrieu
of Louisiana, Ben Nelson of Nebraska, Kent Conrad of North Dakota and
Ron Wyden of Oregon."
The GOP and these neoliberals have turned the clock back 800 years on
fundamental legal conceptions that have governed individual-state
relations. The Bush administration wants to return relations of power to
the position possibly pre-Magna Carta of 1215, and certainly pre 1640.
Article 1 of the Magna Carta states that "all freedoms set out herein
are given to all free-men of our realm, for us and our heirs forever."
Article 29 provides that "no Freeman shall be taken, or imprisoned, or
be dispossessed of his freehold, or liberties, or free customs, or be
enslaved or exiled, but by lawful judgment of his Peers or by the law of
the land."
In the classic text The History of English Law by Frederick Pollock and
Frederic Maitland (1923) the writers said, "[Magna Carta] becomes, and
rightly becomes a sacred text, the nearest approach to an irrepealable
`fundamental statute' that England has ever had.... For in brief it
means this, that the King is and shall be below the law."
It was in the sixteenth century that the writ of habeas corpus first
began to be used consistently as a means of testing the validity of
executive committals to imprisonment and in the seventeenth century, in
the struggle between the Crown and the emerging bourgeoisie, that its
use assumed a revolutionary dimension.
In Darnel's case in 1627, King Charles I (of the Stuart dynasty) had
imprisoned five knights as a result of their refusal to contribute to
repay a forced loan he had taken out. The knights sought their freedom
by issue of writs of habeas corpus and in response the king simply
detained them per speciale mandatum domini Regis. In the case, the court
ruled in favour of the king but in retaliation the parliament passed the
Habeas Corpus Act in 1640 to reverse that decision and curtail the power
of arbitrary executive detention. The Habeas Corpus Act of 1640 provided
that "any person imprisoned by Order of the King or Council should have
habeas corpus and be brought before the court without delay with the
cause of imprisonment shown."

when we were ready to leave, two men from
the department of deportation showed up and escorted us upstairs. Then
they told Germar that he missed a court appointment and was going to be
detained for missing that appointment.
Germar and his attorney said that they never received notice (it is
required to send notice to counsel as well as the petitioner). They
asked for a copy of the letter and that question was never answered.
They also told the men that the 11th circuit federal court had ruled a
stay of further action and that was currently in effect, which means the
INS is not allowed to rule on anything until the federal courts rule on
them (tentative date for that is Jan).
The men said they would review the case and two hours later, they came
and took him away.

Governor Schwarzenegger might give a clue about the exact timing. He's not
likely to be in a photo-op elementary school reading class, though. That

What shall I call this new America in-the-making just three years into a
new century?
These days I find myself unable to swallow what I have told myself, in
both the best and worst of times, about ourselves as Americans.
All the old words have broken loose from reality. They rattle like
falsehoods in the nation's throat.
Based upon how our America now conducts itself among its fellow human
beings - including us, its own citizenry - what is our nation becoming?
What, if we're honest with ourselves, are we to call a system of
government that behaves in these ways:
* Taxes its ordinary people into unfathomable national debt, thereby
ensuring that its rich revel in even more riches, its poor regress into
even more poverty, its military rejoice in even more militarism?
* Devises and enforces policies that starve public services for its most
vulnerable citizenry - its children, its elderly, its working poor, its
racial minorities?
* Sells national and state legislation to the highest bidders from among
wealthy interest groups, while vigorously resisting reforms that would
restore democratic power to the individual?
* Exercises its contempt for the collective will of other nations by
unilaterally tearing up global arms and environmental treaties, while
dismissing both the legal and moral authority of the United
Nations?
* Invades and conquers a sovereign country by fabricating military
intelligence as a pretext for invasion, then, declares "liberation" as its
real intention all along as it expropriates that nation's oil fields?
* Turns one cataracted eye to atrocities in dozens of other countries that
have no oil wells to liberate, the other to a report by Amnesty
International critical of its own behavior as a "liberator"?
* In a work of egregious TV propaganda, lands its supreme leader "at sea"
(costumed as a fighter pilot) on the state-of-the-art USS Abraham Lincoln
to proclaim victory over a third-rate, enfeebled nation?
* Holds nameless prisoners incommunicado, without counsel or charges, for
indefinite periods of time, in addition incarcerating the highest
proportion of its own citizens (most of them black) in the world?
* Actively attempts to nullify laws intended to ensure equality for racial
and other minorities, at the same time invoking evangelical Christianity
as the primary motive for all of its policies?
* Alone among Western nations preserves capital punishment, even seeking
to try alleged murderers in states where, upon conviction, the likelihood
of execution is most probable?
* Threatens the civil rights of individual citizens by expanding its
surveillance and policing powers, including pressuring libraries to
release to federal authorities the reading records of library patrons?
* Conspires to consolidate media control - and thereby dissemination of
"news" information - among corporate leviathans lavishly invested in
perpetuating the incumbent party's political power?

Secret Patriot Act II Destroys What Is Left of American Liberty:
A Brief Analysis of the Domestic Security
Enhancement Act 2003, Also Known as Patriot Act 2

Congressman Ron Paul (R-Tex) told the Washington Times that no
member of Congress was allowed to read the first Patriot Act that was
passed by the House on October 27, 2001. The first Patriot Act was
universally decried by civil libertarians and Constitutional scholars from
across the political spectrum. William Safire, while
writing for the New York Times, described the first Patriot Act's powers
by saying that President Bush was seizing dictatorial control.
On February 7, 2003 the Center for Public Integrity, a non-partisan public
interest think-tank in DC, revealed the full text of the Domestic Security
Enhancement Act of 2003. The classified document had been leaked to them
by an unnamed source inside the Federal government. The document
consisted of a 33-page section by section analysis of the accompanying
87-page bill.
*Note: On February 10, 2003 I discovered that not only was there a house
version that had been covertly brought to Hastert, but that many
provisions of the now public Patriot Act 2 had already been introduced as
pork barrel riders on Senate Bill S. 22. Dozens of subsections and even
the titles of the subsections are identical to those in the House version.
This is very important because it catches the Justice Department in a
bald-faced lie. The Justice Department claimed that the secret legislation
brought into the House was only for study, and that at this time there was
no intention to try and pass it. Now upon reading S. 22, it is clear that
the leadership of the Senate is fully aware of the Patriot Act 2, and have
passed these riders out of their committees into the full bill. I
spent two hours scanning through S. 22 and, let me tell you, it is a
nightmare for anyone who loves liberty. It even contains the Our Lady of
Peace Act that registers all gun owners. It bans the private sale of all
firearms, creates a Federal ballistics database, and much more.
There are other bills in the Senate that grant the Federal government
sweeping powers. S.45 states in section one that the office for State and
local government coordination for Homeland Security will no longer just
oversee, but that now local cities critical functions will be headed by a
Federal director. On Tuesday, February 11th, we noted a story in The
Times-Picayune with the headline: Nagin announces major overhaul of City
Hall -- New Homeland Security office to oversee cops, firemen, emergency
agency. The Federal power-grab taking place is widespread and all
Americans must mobilize to resist it.
Another interesting bill is S. 16. S. 16 is a smorgasbord of Federal
funding and control over local police departments and needs to be examined
closely.
S. 89, The Universal National Service Act of 2003 is the hallmark of an
authoritarian society. The description of the bill is, "To provide for the
common defense by requiring that all young persons in the United States,
including women, perform a period of military service of civilian service
in furtherance of the national defense and homeland security, andfor other
purposes." We have looked at some of the programs that the Federal
government has already been setting up for service here in the "homeland"
and they include East German-style tattletale squads of every type, which
are just basically a super TIPS program. The nightmare goes on and on.

The Patriot Act 2 bill itself is stamped "Confidential - Not for
Distribution." Upon reading the analysis and bill, I was stunned by the
scientifically crafted tyranny contained in the legislation. The Justice
Department Office of Legislative Affairs admits that they had indeed
covertly transmitted a copy of the legislation to Speaker of the House
Dennis Hastert, (R-Il) and the Vice President of the United States, Dick
Cheney as well as the executive heads of federal law enforcement agencies.
It is important to note that no member of Congress was allowed to see the
first Patriot Act before its passage, and that no debate was tolerated by
the House and Senate leadership. The intentions of the White House and
Speaker Hastert concerning Patriot Act II appear to be a carbon copy
replay of the events that led to the unprecedented passage of the first
Patriot Act.
There are two glaring areas that need to be looked at concerning this new
legislation:
1. The secretive tactics being used by the White House and Speaker
Hastert to keep even the existence of this legislation secret would be
more at home in Communist China than in the United States. The fact
that Dick Cheney publicly managed the steamroller passage of the first
Patriot Act, insuring that no one was allowed to read it and publicly
threatening members of Congress that if they didn't vote in favor of it
that they would be blamed for the next terrorist attack, is by the White
House's own definition terrorism. The move to clandestinely craft and then
bully passage of any legislation by the Executive Branch is clearly an
impeachable offense.
2. The second Patriot Act is a mirror image of powers that Julius
Caesar and Adolf Hitler gave themselves. Whereas the First Patriot Act
only gutted the First, Third, Fourth and Fifth Amendments, and seriously
damaged the Seventh and the Tenth, the Second Patriot Act reorganizes the
entire Federal government as well as many areas of state government under
the dictatorial control of the Justice Department, the Office of Homeland
Security and the FEMA NORTHCOM military command. The Domestic Security
Enhancement Act 2003, also known as the Second Patriot Act is by its very
structure the definition of dictatorship.
I challenge all Americans to study the new Patriot Act and to compare it
to the Constitution, Bill of Rights and Declaration of Independence.
Ninety percent of the act has nothing to do with terrorism and is instead
a giant Federal power-grab with tentacles reaching into every facet of our
society. It strips American citizens of all of their rights and grants the
government and its private agents total immunity.
Here is a quick thumbnail sketch of just some of the draconian measures
encapsulated within this tyrannical legislation:
SECTION 501 (Expatriation of Terrorists) expands the Bush
administration's "enemy combatant' definition to all American citizens who
"may" have violated any provision of Section 802 of the first PatriotAct.
(Section 802 is the new definition of domestic terrorism, and the
definition is "any action that endangers human life that is a violation of
any Federal or State law.") Section 501 of the second Patriot Act directly
connects to Section 125 of the same act. The Justice Department boldly
claims that the incredibly broad Section 802 of the First USA Patriot Act
isn't broad enough and that a new, unlimited definition of terrorism is
needed.
Under Section 501 a US citizen engaging in lawful activities can be
grabbed off the street and thrown into a van never to be seen again.
The Justice Department states that they can do this because the person
"had inferred from conduct" that they were not a US citizen. Remember
Section 802 of the First USA Patriot Act states that any violation of
Federal or State law can result in the "enemy combatant" terrorist
designation. [You become a non-citizen by the designation of the
executivebranch.]
SECTION 201 of the second Patriot Act makes it a criminal act for any
member of the government or any citizen to release any information
concerning the incarceration or whereabouts of detainees. It also states
that law enforcement does not even have to tell the press who they have
arrested and they never have to release the names. [And throw away the
key.]
SECTION 301 and 306 (Terrorist Identification Database) set up a national
database of "suspected terrorists" and radically expand the database to
include anyone associated with suspected terrorist groups and anyone
involved in crimes or having supported any group designated as
"terrorist." These sections also set up a national DNA database for anyone
on probation or who has been on probation for any crime, and orders State
governments to collect the DNA for the Federal government.
SECTION 312 gives immunity to law enforcement engaging in spying
operations against the American people and would place substantial
restrictions on court injunctions against Federal violations of civil
rights across the board.
SECTION 101 will designate individual terrorists as foreign powers and
again strip them of all rights under the "enemy combatant" designation.
SECTION 102 states clearly that any information gathering, regardless
of whether or not those activities are illegal, can be considered to be
clandestine intelligence activities for a foreign power. This makes news
gathering illegal. [The only news that's legal to print is THEIR
news--propaganda.]
SECTION 103 allows the Federal government to use wartime martial law
powers domestically and internationally without Congress declaring that a
state of war exists.
SECTION 106 is bone-chilling in its straightforwardness. It states that
broad general warrants by the secret FSIA court (a panel of secret judges
set up in a star chamber system that convenes in an undisclosed location)
granted under the first Patriot Act are not good enough. It states that
government agents must be given immunity for carrying out searches with no
prior court approval. This section throws out the entire Fourth
Amendment against unreasonable searches and seizures.
SECTION 109 allows secret star chamber courts to issue contempt charges
against any individual or corporation who refuses to incriminate
themselves or others. This section annihilates the last vestiges of the
Fifth Amendment.
SECTION 110 restates that key police state clauses in the first Patriot
Act were not sunsetted and removes the five year sunset clause from other
subsections of the first Patriot Act. After all, the media has told us:
"this is the New America. Get used to it. This is forever."
SECTION 111 expands the definition of the "enemy combatant"
designation.
SECTION 122 restates the government's newly announced power of
"surveillance without a court order."
SECTION 123 restates that the government no longer needs warrants and that
the investigations can be a giant dragnet-style sweep described in
press reports about the Total Information Awareness Network. One passage
reads, "thus the focus of domestic surveillance may be less precise than
that directed against more conventional types of crime."
*Note: Over and over again, in subsection after subsection, the second
Patriot Act states that its new Soviet-type powers will be used to fight
international terrorism, domestic terrorism and other types of crimes. Of
course the government has already announced in Section 802 of the first
USA Patriot act that any crime is considered domestic terrorism.
SECTION 126 grants the government the right to mine the entire spectrum of
public and private sector information from bank records to educational and
medical records. This is the enacting law to allow ECHELON and the Total
Information Awareness Network to totally break down any and all walls of
privacy.
The government states that they must look at everything to "determine" if
individuals or groups might have a connection to terrorist groups. As
you can now see, you are guilty until proven innocent.
SECTION 127 allows the government to takeover coroners' and medical
examiners' operations whenever they see fit. See how this is like Bill
Clinton's special medical examiner he had in Arkansas that ruled that
people had committed suicide when their arms and legs had been cut off.
SECTION 128 allows the Federal government to place gag orders on Federal
and State Grand Juries and to take over the proceedings. It also disallows
individuals or organizations to even try to quash a Federal subpoena. So
now defending yourself will be a terrorist action.
SECTION 129 destroys any remaining whistleblower protection for Federal
agents.
SECTION 202 allows corporations to keep secret their activities with
toxic biological, chemical or radiological materials.
SECTION 205 allows top Federal officials to keep all their financial
dealings secret, and anyone investigating them can be considered a
terrorist. This should be very useful for Dick Cheney to stop anyone
investigating Halliburton.
SECTION 303 sets up national DNA database of suspected terrorists. The
database will also be used to "stop other unlawful activities." It will
share the information with state, local and foreign agencies for the same
purposes.
SECTION 311 federalizes your local police department in the area of
information sharing.
SECTION 313 provides liability protection for businesses, especially
big businesses that spy on their customers for Homeland Security,
violating their privacy agreements. It goes on to say that these are
all preventative measures - has anyone seen [the movie] Minority Report?
This is the access hub for the Total Information Awareness Network.
SECTION 321 authorizes foreign governments to spy on the American
people and to share information with foreign governments.
SECTION 322 removes Congress from the extradition process and allows
officers of the Homeland Security complex to extradite American citizens
anywhere they wish. It also allows Homeland Security to secretly take
individuals out of foreign countries.
SECTION 402 is titled "Providing Material Support to Terrorism." The
section reads that there is no requirement to show that the individual
even had the intent to aid terrorists.
SECTION 403 expands the definition of weapons of mass destruction to
include any activity that affects interstate or foreign commerce.
SECTION 404 makes it a crime for a terrorist or "other criminals" to
use encryption in the commission of a crime.
SECTION 408 creates "lifetime parole" (basically, slavery) for a whole
host of crimes.
SECTION 410 creates no statute of limitations for anyone that engages
in terrorist actions or supports terrorists. Remember: any crime
is now considered terrorism under the first Patriot Act.
SECTION 411 expands crimes that are punishable by death. Again, they
point to Section 802 of the first Patriot Act and state that any
terrorist act or support of terrorist act can result in the death penalty.
SECTION 421 increases penalties for terrorist financing. This section
states that any type of financial activity connected to terrorism will
result to time in prison and $10-50,000 fines per violation.
SECTIONS 427 sets up asset forfeiture provisions for anyone engaging in
terrorist activities.
There are many other sections that I did not cover in the interest of
time. The American people were shocked by the despotic nature of the first
Patriot Act. The second Patriot Act dwarfs all police state legislation
in modern world history.
Usually, corrupt governments allow their citizens lots of wonderful rights
on paper, while carrying out their jackbooted oppression covertly. From
snatch and grab operations to warrantless searches, Patriot Act 2 is an
Adolf Hitler wish list.
You can understand why President Bush, Dick Cheney and Dennis Hastert want
to keep this legislation secret not just from Congress, but the American
people as well. Bill Allison, Managing Editor of the Center for Public
Integrity, the group that broke this story, stated on my radio show that
it was obvious that they were just waiting for another terrorist attack to
opportunistically get this new bill through. He then shocked me with an
insightful comment about how the Federal government was crafting this so
that they could go after the American people in general. He also agreed
that the FBI has been quietly demonizing patriots and Christians and
"those who carry around pocket Constitutions."
I have produced two documentary films and written a book about what
really happened on September 11th. The bottom line is this: the
military-industrial complex carried the attacks out as a pretext for
control. Anyone who doubts this just hasn't looked at the mountains of
hard evidence.
Of course, the current group of white collar criminals in the White House
might not care that we're finding out the details of their next phase.
Because, after all, when smallpox gets released, or more buildings start
blowing up, the President can stand up there at his lectern suppressing a
smirk, squeeze out a tear or two, and tell us that "See I was right. I had
to take away your rights to keep you safe. And now it's your fault that
all of these children are dead." From that point on, anyone who criticizes
tyranny will be shouted down by the paid talking head government
mouthpieces in the mainstream media.
You have to admit, it's a beautiful script. Unfortunately, it's being
played out in the real world. If we don't get the word out that
government is using terror to control our lives while doing nothing to
stop the terrorists, we will deserve what we get -- tyranny. But our
children won't deserve it.
It was, apparently, just a
matter of time.

As for creating confusion in the minds of Fox News viewers, we digress
-we're sure he knows the intellectual level of the average Fox News viewer
better than we do.
Our Bill O'Reilly Hitler Youth Tee doesn't even have the word "Fox" or
"Bill O'Reilly" on it, yet according to Mr. Silvestri, "The T-shirt
'O'Reilly Youth Tee', in addition to the infringements described herein,
shows incredibly poor taste on your part, is highly offensive and clearly
demonstrates your bad faith use of the Fox Copyrights and Trademarks."
Now isn't that a hoot: to be accused of "incredibly poor taste" and being
"highly offensive" by a representative of the network responsible for such
benchmarks of good taste such as "Temptation Island 3", "Joe Millionaire"
and "Stupid Behavior Caught On Tape".
The irony is so thick you can cut it with a knife.
Without a doubt, this is a First Amendment issue and has nothing at all to
do with copyright infringement. Apparently the "patriots" at Fox believe
in the Constitution except when it comes to an unemployed graphic designer
calling them on their unrepentant, blatant Republican bias, exposing it
for what it is and striving to educate the American public about it.
Patriot, war hero and author of Born On The Fourth of July, Mr. Ron
Kovic has said that " The Agitproperties guys are doing some of the most
important work in American media today."
We have to agree.
Websites like ours are few and far between. If we get shut down, our
self-appointed mission of educating this country about the right wing
corporate takeover of the American media will be finished.
The recent FCC ruling vis-a-vis loosening restrictions on corporate
communications monopolies has, if anything, made us even more aware of how

Greenspan printed $5 trillion since taking the helm of the Fed, weakening
dollar and making US vulnerable to inflation
Those who follow financial markets may be familiar with the term
"strong-dollar policy," which is used by Bush administration officials and
Federal Reserve
Chairman Alan Greenspan. One might assume that such a policy entailed a
course of action designed to strengthen the value of the U.S. dollar.
However, if we judge Fed policy by Mr. Greenspan´s actions rather than his
words, it appears we have a weak-dollar policy, a policy that erodes the
value of your personal savings. The "strong-dollar policy" is nothing more
than an empty political slogan.
The inescapable truth is that the value of the U.S. dollar has fallen over
30% in the past year, which to most people would not seem indicative of
strength. There are several reasons for this decline, but the single
biggest factor
has been Greenspan´s relentless increase of the money supply. There are
roughly $16 trillion dollars in worldwide use today, $5 trillion more than
when Greenspan became Fed chair. The law of supply is immutable: When
dollars are abundant they are also cheap.
With 46% more dollars in
circulation than when he took office, the value of the dollar has dropped
over 30% in just the last year and still going down. This process is
making your buck worth less and since your wages aren't going up as fast
as the dollar is dropping....you're getting poorer and poorer and maybe
haven't even notice it...but you will, and so will the rest of America.
But don't worry, right? Bush will take care of you. After 9-11 Bush issued
a series of executive orders and Congress thinks they are just dandy. If
there is a financial "upset" Bush has Executive Order #11051 which gives
the Office of Emergency Planning authorization to put all Executive Orders
into effect in times of increased international tensions and economic or
financial crisis.
Bush will let you know when he takes control of America (if he so chooses)
because then he can implement Executive Order #10995, which allows the
government to seize and control all communication media. Then he can deal
with the financial emergency with Executive Order #11921 that allows the
Federal Emergency Preparedness Agency to take control of the mechanisms of
production and distribution, of energy sources, wages, salaries, credit
and the flow of money in U.S. financial institutions in any undefined
national emergency. It also provides that when a state of emergency is
declared by the President, Congress cannot review the action for six
months. Executive Order #11004 allows the Housing and Finance Authority to
relocate communities, build new housing with public funds, designate areas
to be abandoned, and establish new locations for populations, so you'll
still have a place to stay after they take your house, and since EO #11000
allows the government to mobilize civilians into work brigades under
government supervision, you'll have plenty work to do. There will also be
plenty of food, because EO #10998 allows the government to take over all
food resources and farms. And if Bush fakes the whole thing, don't worry.
Congress can fix it...after six months since No. 11921 provides that when
a state of emergency is declared by the President, Congress can not review
the action until after six months.

Republican Convention protests in New York Seven months after the mass arrests of over 1,800 protesters at the
Republican Convention in New York City last summer, 91 percent of the
nearly 1,700 cases that have been concluded have resulted in acquittals
or the dismissal of charges. Four hundred cases were dismissed after
video recordings made by volunteer observers and others showed that
there was no reason for the arrests, the New York Times reported last
week. Some of the videos also exposed false testimony by the police.

The House of Representatives is scheduled to take up Rep.
Sensenbrenner's REAL ID Act (H.R. 418) next WEDNESDAY, with a vote
likely THURSDAY, FEB. 10 Sending refugees who have fled
torture, rape, and other brutal human rights abusers back to their
tormenters and deporting long-term residents for charity contributions
they made long ago will not make Americans safer from terrorism. Yet
sections of H.R. 418 would do just that. To avoid debate over the
bill's controversial provisions, the sponsor plans to attach his
bill to a fast-approaching "must pass" bill, such as the the Iraqi
supplemental spending bill or the relief bill for tsunami victims.
Summaries of a few troubling sections and a sample phone script
follow. Here are links for more information:
- Section 101, which enables a judge to deny a refugee asylum if she
is unable to track down specific documents that corroborate her
claims--even if the U.S. State Department confirms that the country
from which the refugee has fled never provides the documents--and bars
other judges from reversing their determinations because the
corroborating evidence is not available.
- Sections 103 and 104 would permit long-term legal U.S. residents
to be deported for having given contributions years ago to
organizations that later fit the Bush administration's profile of a
terrorist organization, even if they are not on a list of named
terrorist organizations. This is ex post facto law, a violation
of US and International Law.

Padilla, an American citizen, an "enemy combatant." The president did this
all by himself, even though--quoting a friend of the court brief to the
Second Circuit Court of Appeals by a historic array of former federal
judges and establishment lawyers:
"There is no constitutionally approved
definition of who is an 'enemy combatant.' " Nor is there any basis in our
laws for holding Jose Padilla indefinitely without charges, or access to
his lawyer, Donna Newman who, "...after combing through sealed
court papers the Justice Department was obliged to reveal . . . concluded
that the government's case against her client relies on two informers: one
with a drug problem, she said, and the other who has recanted."
Supreme Court Justice Robert Jackson's
concurring opinion in Youngstown Sheet & Tube v. Sawyer
(1952) that the commander in chief's power "is not such an absolute--as
might be implied from that office in a militaristic system--but is subject

Legal Times,
22 October, 2001, US Attorney General John Ashcroft wrote,
"We're going to
protect and honor the Constitution, and I don't have the authority to set it
aside. If I had the authority to set it aside, this would be a dangerous
government, and I wouldn't respect it. We'll not be driven to abandon our
freedoms by those who would seek to destroy them."
Do you agree with
Ashcroft that he doesn't have the authority to set aside the Constitution?
Would you agree with John Ashcroft that any government that tried to do so
is a dangerous government? Would you agree with John Ashcroft that such a
government was not worthy of our respect? Would you agree with John Ashcroft
that we should not allow terrorists to seek to destroy our freedoms?
I agree with him
on all of these points. Do you? Seems as though we must call for a regime
change to prevent our own government from destroying our liberty and freedom
as an answer to the insecurity and fear of terrorism. Sometimes hard choices
are the only solution.

a draft copy of the "Vital Interdiction of Criminal Terrorist
Organizations Act of 2003," also known by the Orwellian sobriquet "VICTORY
Act." The draft obtained by Libertythink is dated June 27, and word in the
Beltway is that the VICTORY Act is still being retooled over the August
recess before it is introduced in the Senate.
Although this may not be the final form of the act, Libertythink
encourages its readers to study the bill and hit Ashcroft with hard
questions when and if he comes to your town.
Jail John Ashcroft for contempt for violating oath
U.S. District Judge Leonie Brinkema is expected to issue a critical
sanction any day in the federal criminal case prosecution of Zacharias
Moussaoui, who is charged with having conspired to participate in the
September 11 terrorist attacks. The order arises out of the government's
refusal to comply with the judge's order that the government produce for
deposition Ramzi Binalshibh, a suspected high al-Qaeda official who is
currently in U.S. custody. Moussaoui is seeking Binalshibh's testimony to
help establish his innocence of the charges.
Judge Brinkema's original order granted Moussaoui's request based on the
Sixth Amendment to the U.S. Constitution, which guarantees the right of an
accused in federal criminal prosecutions to summon witnesses in his behalf
at his trial. Despite the oath that the attorney general took to support
and defend the Constitution when he was sworn in office, John Ashcroft has
chosen to knowingly, intentionally, and deliberately disobey Judge
Brinkema's order by refusing to produce Binalshibh for testimony.
The judicial response could be an indefinite sentence in prison.
Back to the Constitution
Congress has returned from summer recess
and will be addressing several pieces of legislation that directly affect
your right to privacy and freedom from government surveillance.
The Senate will soon begin considering an important bill that responds to
recent government actions and several of the PATRIOT Act's most grievous
provisions -- including one that allows government agents to conduct
"sneak and peek" searches of your home or office. Not only would the bill
require a higher standard of proof before allowing government
access to highly private and sensitive data (such as library, bookstore
and medical records), it also bans federal agencies from engaging in
"data-mining" without explicit congressional authorization.
This legislation would correct many of the PATRIOT Act's flaws and protect
constitutional rights threatened by other government actions. It deserves

On June 4, 2003, the Establishment launched its juggernaut of deception -
the "Continuity of Government." The Establishment is working to amend the
Constitution of the United States. If it succeeds, our system of
government will be changed forever.
"Continuity of Government" is led by the Brookings Institution and the
American Enterprise Institute. It is funded by the Carnegie Corporation of
New York, the William and Flora Hewlett Foundation, the David and Lucille
Packard Foundation, and the John D. and Catherine T. MacArthur Foundation.
"Continuity of Government" appears to be well-intentioned and sensible.
You might have read articles and commentaries expressing such impressions.
Yet, in reality, "Continuity of Government" is a dangerous deception upon
the American people.
The backers of the "Continuity of Government" are on a fast track to amend
the Constitution. They want their proposed constitutional amendment passed
by Congress and ratified by 38 states within the next 14 to 18 months.
Don't be deceived. First comes a "terrorist conspiracy" and then a move to
remove the inconvenience of elections. How much more clear must the
picture be before Americans stand up and say NO to dictatorship and
fascism?
Bush, Rumsfeld, Cheney and Powell have VIOLATED the

By fabricating or misrepresenting intelligence data on
terrorism, such as WMD in Iraq, Top level officials of the Bush
Administration, including Bush, Cheney, Rumsfeld, Rice, Powell, Perle,
Wolfowitz and other have committed FELONY CLASS violations of the U.S.A.
Patriot Act.

President Bush and his lieutenants are alleged to have

including American citizens, the attempted assassination of the leader of
Iraq (whose fate is still unknown), the unwarranted attack against another
sovereign nation, the unlawful detainment of thousands outside the reach
of the U.S. justice system, all of which has cost U.S. taxpayers hundreds
of billions of dollars. Given that Afghanistan was not recognised by many
countries, what was and continues to be done there in the name of Freedom,
is left to your own description.

of manned and unmanned aerial vehicles that could be used to disperse

PALO ALTO, Calif. - Librarians plan to shred documents and delete
computerized records of patrons' reading habits as part of their battle
against the U.S. Patriot Act, the federal anti-terrorism law that eases
the way for the FBI to view library records.
The Palo Alto librarians, saying it's all part of an effort to protect
reader privacy, have agreed to destroy the computer records within six
days of any transaction.
The librarians say paper records, including inter-library loan requests,
book reserve lists and sign-up lists for the library's public computers,
are being shredded immediately after use.
"We've had a longstanding policy of confidentiality of library records,
and in light of the passage of the Patriot Act, we're reviewing and
tightening our business practices," said Diane Jennings, the acting city
librarian.
In a separate move, Palo Alto's police chief is supporting a resolution
before the Cicty Council next week that would prohibit her department from
aiding the FBI in Patriot Act searches, interviews or surveillance without
evidence that a crime has been committed.
"We take an oath to uphold the Constitution and that's the bottom line for
us," said Chief Lynne Johnson. "We believe we are still able to protect
the people of this community, but won't do so by violating people's
constitutional and civil rights."

no-accountability contracts worth billions (one observer calls it "the

JOHN ASHCROFT GOES AFTER THE INTERNET by Cheryl Seal
I am not a gambler and I think gambling is an addiction, like any other
addiction. However, I am appalled to learn that John Ashcroft is "going
after gambling" as a way to start dismantling the Internet as we know
it. The Bush administration's greatest enemy is the Internet, because it
is here that people can access the non-corporate truth, can safely
communicate and organize quickly (the peace protests relied on Internet
organizing). However, the popularity of the Net has made it difficult
for the Bush Reich to find a chink in its armor that would not outrage
the public. Now Ashcroft is trying an angle he imagines to be his "foot
in the door" : gambling. To this end, he is going after PayPal as the
broker of online gambling funds.
HOWEVER, if Ashcroft were really going after online gambling for what
it is - a vice, then the FBI vice people should be going after it -
at least what's left of the domestic crime-fighting FBI. If the issue
was unregulated money transfer, then the SEC should be on the case.
But no, Ashcroft is accusing PayPal of violating the PATRIOT ACTS!!!
More outrageous still, the charges originate from transactions that
occurred BEFORE the Patriot Act was made law!! Even more suspicious, the
case is focused on Missouri - Ashcroft's home state, where, as a former
corporate-fed senator, he has all sorts of "markers" he can call in to
try to rig his case and make it stick.
So, if he succeeds in making online gambling a violation of the Patriot
Act, you can rest assured that this will be but the toe in door. By this
time next year, nearly everything short of using email to send notes of
support to G.W. Bush will be considered a "violation of the Patriot
Act."
Just in time for his next war.

Starting this week, the nation's largest discount retailer will quietly
begin selling tracking-chipped products to clueless shoppers. The first
volley in their war against our privacy is set to start at their Brockton,
Massachusetts store.
Wal-Mart will put Radio Frequency I.D. sensors on shelves stocked with
RFID-tagged Gillette products, but they'd rather you didn't know about it,
because, hey, you might not like it, and then you might make noise and
then they'd have a big PR mess on their hands.
You might even stop buying Gillette products or, say, refuse to shop at
Wal-Mart.
These chips, researched at M.I.T.'s Auto-ID Center are about the size of a
grain of sand. Chipsters say the technology will only be used to help
retailers keep track of inventory - like bar codes. But privacy-loving
consumers question the very concept of a device that sends out radio waves
to "readers" that not only identify the article, but where and with whom
it's going.
The Big Brother implications of this thing need little hyping to get your
skin crawling.

What is Section 215 of the USA PATRIOT ACT?
Section 215 allows the FBI to order any person or entity to turn over "any
tangible things," so long as the FBI "specif[ies]" that the order is "for an
authorized investigation . . . to protect against international terrorism or
clandestine intelligence activities."
Section 215 vastly expands the FBI's power to spy on ordinary people
living in the United States, including United States citizens and permanent
residents.
The FBI need not show probable cause, nor even reasonable grounds to
believe, that the person whose records it seeks is engaged in criminal
activity.
The FBI need not have any suspicion that the subject of the investigation
is a foreign power or agent of a foreign power.
The FBI can investigate United States persons based in part on their
exercise of First Amendment rights, and it can investigate non-United States
persons based solely on their exercise of First Amendment rights.
For example, the FBI could spy on a person because they don't like the
books she reads, or because they don't like the web sites she visits. They
could spy on her because she wrote a letter to the editor that criticized
government policy. Those served with Section 215 orders are prohibited
from disclosing the fact to anyone else. Those who are the subjects of the
surveillance are never notified that their privacy has been compromised.
If the government had been keeping track of what books a person had been
reading, or what web sites she had been visiting, the person would never
know.
Is Section 215 Constitutional?
Normally, the government cannot effect a search without obtaining a warrant
and showing probable cause to believe that the person has committed or will
commit a crime. Section 215 violates the Fourth Amendment by allowing the
government to effect Fourth Amendment searches without a warrant and without
showing probable cause.
The violation of the Fourth Amendment is made more egregious by the fact
that Section 215 might be used to obtain information about the exercise of
First Amendment rights. For example, the FBI could invoke Section 215 to
require a library to produce records showing who had borrowed a particular
book or to produce records showing who had visited a particular web site.
Section 215 might also be used to obtain material that implicates privacy
interests other than those protected by the First Amendment. For example,
the FBI could use Section 215 to obtain medical records.
The provision violates the First Amendment by prohibiting those served
with Section 215 orders from disclosing that fact to others, even where
there is no real need for secrecy.
The provision violates the First Amendment by effectively authorizing the
FBI to investigate U.S. persons, including American citizens, based in part
on their exercise of First Amendment activity, and by authorizing the FBI to
investigate non-U.S. persons based solely on their exercise of First
Amendment activity.
The provision violates the Fourth and Fifth Amendments by failing to
require that those who are the subject of Section 215 orders be told that
their privacy has been compromised.
Doesn't the government need these powers?
The government already has the authority to prosecute anyone whom it has
probable cause to believe has committed or is planning to commit a crime. It
also has the authority to engage in surveillance of anyone whom it has
probable cause to believe is a foreign power or spy - whether or not the
person is suspected of any crime.
Section 215 takes away a great deal of our liberty and privacy but isn't
likely to get us any security in return.
There's a real possibility that setting the FBI loose on the American public
will have a profound chilling effect on public discourse. If people think
that their conversations and their e-mails are their reading habits are
being monitored, people will inevitably feel less comfortable saying what
they think, especially if what they think is not what the government wants
them to think. Is the FBI abusing its powers?
Attorney General Ashcroft has gone to great lengths to keep secret even
the most basic information about the FBI's spying. For example, in
answering questions posed by the House Judiciary Committee, he classified
information that should not have been classified, including information
that would have shown how often the FBI is spying on people based on their
exercise of First Amendment rights.
The little information that we do have suggests that the FBI is abusing
its powers.
For example, a survey conducted by the University of Illinois suggested
that, by December 2001, the FBI had already approached 85 out of some 1500
libraries.
The ACLU has filed a request under the Freedom of Information Act to
force the government to disclose more information about the FBI's use of
Section 215 and about the pervasiveness of domestic spying more generally.

massive computer surveillance system that would have the power to track
people as never before.

charge of the ultimate government surveillance program. This is likely to

One day before Democrats ended their boycott of
the Texas House last week, the Texas Department of Public Safety ordered
the destruction of all records and photos gathered in the search for them,
documents obtained Tuesday show.
A one-sentence order sent by e-mail on the morning of May 14 was
apparently carried out, a DPS spokesman said Tuesday. The revelation comes
as federal authorities are investigating how a division of the federal
Homeland Security Department was dragged into the hunt for the missing
Democrats - at the request of the state police agency.
Attorney-Client Privilege Revoked Retroactively
The government says it can pry into the attorney-client
relationship all it wants
Lynne Stewart, a New York human-rights lawyer with a taste for radical
politics, is accustomed to representing unpopular clients.
She never dreamed it would become illegal.
Stewart was in Seattle on Monday as part of a national campaign to drum
up support--not for a client, but for her own case. Stewart was a member
of the court-appointed defense team for Sheikh Omar Abdel Rahman, who is
serving a life sentence in connection with the first World Trade Center
bombing in 1993. After his conviction, Stewart continued as one of the
lawyers representing Abdel Rahman. The Seattle visit came just over a
year after her arrest April 8, 2002, when she was taken from her home
without warning. Federal agents combed through her office, seizing files
on all of her cases, and Attorney General John Ashcroft proudly
announced that Stewart had been charged in a four-count criminal
indictment with aiding and abetting a terrorist organization--solely for
her work in representing Abdel Rahman.
Stewart's case, now winding its way through pretrial motions toward a
January trial, stands as a critical test for the Bush administration's
newly reserved right to violate lawyer-client confidentiality in order
to wage the war on terror. It also has a significant First Amendment
component. Stewart's indictment charges her with discussing Abdel
Rahman's case with a Reuters reporter--even though no gag order barred
her from doing so; with talking while an interpreter was speaking with
her client during a consultation in his prison cell, thereby preventing
the Justice Department from taping their conversation in Arabic; and
with allowing the interpreter and client to speak in Arabic about
nonlegal matters. If convicted, she faces 40 years in prison.
THE CHARGES STRIKE at the heart of the U.S. Constitution's Sixth
Amendment guarantee that all people accused of a crime are entitled to
effective representation by an attorney. Courts have long held that
attorney-client confidentiality is essential to that right; without the
ability to speak freely about what they have, and have not, done,
defendants are severely impaired from learning their legal status and
options, and attorneys cannot mount the best defense. But Stewart's case
has broader implications. In the future, attorneys will be less willing
to represent clients like Abdel Rahman.
TRUTH ABOUT THE PATRIOT ACT

What is the significance of Attorney General Ashcroft's latest whistle
stop tour in defense of the USA PATRIOT Act? A careful review shows this
latest spin campaign is consistent with an ongoing pattern of Justice
Department misinformation. Over the past year FBI agents and Justice
Department spokespersons have been repeating similar statements in
newspaper articles, public forums and editorial pages around the
country. Their main points boil down to implying that the PATRIOT Act
only applies to terrorists, not citizens, and that the FBI can use these
new powers only in terrorism investigations with the consent of a judge
under "probable cause" standards of evidence. Oregon's former top FBI
agent, Charles Matthews, was recorded saying these very things in a
February forum put on by the Friends of the Ashland Library.
Incredibly, it turns out that all of these statements made by
many senior FBI agents and Justice Department officials are factually
and thoroughly incorrect. The truth is that the FBI can engage in
searches and surveillance activities, and obtain medical, financial,
library, school, and other kinds of personal records with a mere showing
of "relevance" to a terrorism investigation. This is a much lower legal
standard than probable cause. The persons to whom the records pertain do
not even need to be themselves suspects in an investigation.
Finally, a judge is required to issue a court order for release of such
records without requiring that the FBI substantiate the basis for
seeking the information. What this all means is that the PATRIOT Act
allows the FBI to use broad new search and surveillance powers against
American citizens who are not even suspected of involvement in terrorism
related activities. By removing the checks and balances protections of
judicial oversight the PATRIOT Act undermines the very foundations of
liberty. We are left to simply trust the good intentions of the FBI.
Attorney General Ashcroft is also making unsubstantiated claims that the
PATRIOT Act would definitively have prevented the 9/11 attacks.
The PATRIOT Act and related Justice Department regulations have been
used to justify dragnet detentions of thousands of immigrants in
violation of international human rights standards. Thousands of people
have been held for long periods without criminal charges and without
access to
attorneys or contact with families. There is actually ample
evidence that law enforcement and intelligence agencies already had
substantial powers that were not used effectively to thwart the 9/11
attacks. It may be true that changes to existing laws are needed to
improve coordination between domestic law enforcement and intelligence
agencies. But the PATRIOT Act goes way too far in the direction of
degrading Constitutionally protected due process of justice for citizens
and immigrants alike.

President Bush does NOT have power to
detain American citizen Jose Padilla, the former gang member seized on
U.S. soil, as an enemy combatant, a federal appeals court ruled Thursday.
The decision, which ordered that Padilla be released from military custody
within 30 days, could force the government to try the "dirty bomb" plot
suspect in civilian courts. In a 2-1 ruling, a three-judge panel of the
2nd U.S. Circuit Court of Appeals said Padilla's detention was not
authorized by Congress and that Bush could not designate him as an enemy
combatant without the authorization.
[But obviously ONE of the three judges violated his oath to support the
Constitution.]
